Scope of Application

These General Terms and Conditions govern the contractual relationship between Mike Matter Coaching GmbH (hereinafter referred to as the “Coach”) and the client (hereinafter also referred to as the “Client”) and apply to all business transactions conducted under these terms.

Conclusion of the contract

The contractual relationship, and thus the engagement, comes into effect through the coach's written confirmation of the appointment. If the parties draw up a written contract, the contractual relationship and thus the engagement comes into effect upon signing the written contract. Upon engagement, the terms of these General Terms and Conditions are deemed accepted. Any deviations from these General Terms and Conditions must be agreed upon in writing in advance. The coaching relationship is a mandate under Article 394 of the Swiss Code of Obligations (OR).

 Scope of Services / Offer

The coach offers personal coaching services in the form of individual sessions and coaching packages. The basis for the specific scope of services is the prior clarification of the engagement between the coach and the client (the so-called first session, cf. section 4 below). The range of services includes a paid first session as well as packages of varying duration, each containing a discovery phase (Discovery) and the coaching sessions that build on it. Appointments are arranged personally between the coach and the client and confirmed in writing by the coach.

Coaching Process

The collaboration begins with a first session in which the coach and the client examine whether a shared basis exists. In this first session, the appropriate coaching package is also selected. The first session takes place exclusively in the coaching space in Hindelbank or as Online Coaching.

Each package thus consists of a Discovery phase (Discovery, 2 sessions) and a set number of coaching sessions. The coaching sessions take place in one of the five formats offered: coaching space in Hindelbank, Online Coaching, Nature Coaching, Walk & Talk, or Your Place. The format is chosen freely for each session. 

Client Cooperation and Responsibility 

Coaching is based on cooperation and mutual trust. Clients are responsible for their own learning and change process. The coach provides guidance and support. Success cannot be guaranteed. Open communication and active participation on the part of the client are essential for a successful partnership.

Ethics and Data Handling

Mike Matter Coaching is committed to adhering to the International Coaching Federation’s (ICF) Code of Ethics and operates in accordance with the principles of its own code of ethics.

The coach collects, processes, and uses clients’ personal data solely for the purpose of fulfilling the contract and handling organizational matters.

Personal data and coaching content are only disclosed with explicit, written consent, or when required by law, or when strictly necessary for contract processing (e.g. accounting software). In such cases, corresponding data processing agreements are concluded. Data is deleted after the coaching ends, once the statutory retention obligations have expired. 

Payment and Billing

Prices are set in Swiss francs (CHF) and are based on the price list in effect at the time the contract is concluded. The packages and prices are always up to date and can be viewed on the website under “Offers & Prices.”

First sessions are billed individually. Coaching packages are billed as a total amount before the start of the package. The first session can take place before payment is received.

The invoice is due within 30 days of the invoice date. Payments must be made exclusively by bank transfer.

Each package has a specified validity period that begins with the first session of the package. Unused sessions expire at the end of the validity period, and no refunds will be issued.

The agreed-upon package price applies for the entire duration of the booked package. Price adjustments will be announced on the website at least four weeks in advance and apply exclusively to new bookings. Before a price adjustment takes effect, you have the option to book a package at the previous price.

The package price includes preparation and follow-up for the sessions, work materials, reflection questions, methodological tools, travel expenses, and all other expenses.

Cancellation of an Appointment and Termination of the Engagement 

Scheduled appointments can be rescheduled or canceled free of charge up to 24 hours before the start time. After that, the full amount for the session will be charged.

A booked coaching package is generally binding and cannot be cancelled. In justified exceptional cases (in particular in the event of documented illness, accident, or comparable unforeseeable circumstances), a partial refund may be considered upon written request. Sessions already used are billed at the single-session rate (according to the current price list). Any remaining difference is refunded upon agreement. There is no legal entitlement to a refund.

Liability and Insurance

Mike Matter Coaching is not liable for any claims arising from the content or conduct of a coaching session, training program, or other service, or from any unintended individual effects thereof. To the extent permitted by law, all liability is excluded. Insurance is the responsibility of the client and/or the participant. 

Confidentiality

The coach is bound by a duty of confidentiality. He or she agrees to maintain complete confidentiality regarding all information about the client that becomes known in the course of his or her work.

Severability and Order of Precedence

If certain provisions of the Terms and Conditions are or become legally invalid, the legal validity of the remaining provisions shall not be affected.

In the event of a conflict, incompatibility, or discrepancy, the provisions of the individual contractual relationship shall prevail over the terms of these General Terms and Conditions.

Governing Law and Jurisdiction

The contractual relationship is governed by Swiss law.

The place of jurisdiction for any legal disputes arising from or in connection with the contractual relationship is Hindelbank.
